Refund Policy

1) RIGHT OF WITHDRAWAL 

1.1) Legal withdrawal period

In accordance with the applicable legal provisions, the Buyer has 14 days from receipt of the Products to exercise the right of withdrawal without having to give any reason or pay any penalty.     

After notifying support@le-bon-voyage.com by email of their decision to exercise the right of withdrawal within this 14-day period (including a photo of the product as a whole, as well as a photo of the product label showing its size, where applicable), the Buyer has a further 14 days to return the product(s) concerned by the withdrawal. 

Please note: before returning any product, please contact us by email and wait for a reply from our customer service team. Depending on the issue (faulty item, sizing issue, etc.), the return and refund procedure may differ.

1.2) Conditions for exercising the right of withdrawal

If the right of withdrawal is exercised within the period referred to in 1.1, only the price of the product(s) purchased and the delivery costs will be refunded. Return costs remain the responsibility of the Buyer.

Returns must be sent back in their original condition and complete (packaging, accessories, instructions, etc.) so they can be resold as new, and, where possible, should be accompanied by a copy of the purchase invoice to help us process the return more efficiently.

If the product has lost value as a result of handling beyond what is necessary to establish its nature, characteristics and proper functioning, the Buyer may be held liable.

To exercise the right of withdrawal, in accordance with the applicable legal provisions, the Buyer will find attached at the bottom of this page, as Annex 2 to these Terms and Conditions of Sale, a standard withdrawal form to send to the following email address: support@le-bon-voyage.com

The Buyer must clearly state their decision to withdraw and specify the order concerned by the withdrawal.

Once the cancellation form or withdrawal notice has been sent no later than 14 days after receiving the order, the Buyer must return the relevant product(s) within a reasonable timeframe and, at the latest, within 14 days of sending the cancellation form or withdrawal notice.

To obtain an estimate of the return costs payable by them, the Buyer may visit the supplier’s website, as indicated in their order confirmation email.

This estimate of return costs is not binding on the Company. The price payable for returning the product may vary depending on the carrier chosen by the Buyer to return the product(s).            

1.3) Products excluded from the right of withdrawal

In accordance with the regulations in force, the right of withdrawal cannot be exercised for audio or video recordings or computer software that has been unsealed by the customer, goods made to the customer’s specifications or personalized items, and goods unsealed by the customer that cannot be returned for hygiene or health protection reasons. Likewise, the right of withdrawal cannot be exercised for gift boxes.

1.5) Refunds

If the right of withdrawal is exercised, the Company will refund the sums paid no later than 14 days from the date on which the Company is informed of the Buyer’s decision to withdraw, using the same payment method as the one used for the order (unless the Buyer expressly agrees to a refund by another payment method).         

This refund date may be deferred until the product has been recovered or until the Buyer has provided proof that the product has been dispatched, whichever comes first.    

If no refund is made within 14 days from the date on which the Company is informed of the Buyer’s decision to withdraw, Le Bon Voyage may be required to refund the sums due plus statutory interest if the refund delay is less than 11 days, 5% if the delay is between 10 and 20 days, 10% if the delay is between 20 and 30 days, 20% if the delay is between 30 and 60 days, and 50% if the delay is between 60 and 90 days.


The Company is not required to reimburse the Buyer for any additional costs if the Buyer has expressly chosen a delivery method that is more expensive than the standard delivery option offered on the Site.

Refunds for purchases made with gift vouchers will be issued exclusively in the form of gift vouchers for the same amount originally paid using that method.

Any benefits received when purchasing a product, in particular through a loyalty card, will be cancelled if the product is returned and refunded.

2) LEGAL GUARANTEES          

2.1) Legal guarantee of conformity           

In accordance with the legal provisions (Annex 1), the seller is liable for any lack of conformity appearing in its products within two (2) years from delivery of the item. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation where this was made their responsibility under the contract or carried out under their responsibility. 

This guarantee applies by law in accordance with the provisions of the Annex to Article D. 211-2 of the Consumer Code

A.—Box to be included in the general terms and conditions of sale for goods (excluding domestic animals)

 

The consumer has a period of two years from delivery of the item to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to demonstrate the existence of the lack of conformity, and not the date on which it appeared.

 

Where the sales contract provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the stated supply period. During this period, the consumer is only required to demonstrate the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared.

 

Where applicable, the legal guarantee of conformity requires the trader to provide all updates necessary to keep the item in conformity.

 

Under the legal guarantee of conformity, the consumer is entitled to have the item repaired or replaced within thirty days of their request, free of charge and without major inconvenience.

 

If the item is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

 

If the consumer requests repair of the goods, but the seller imposes replacement instead, the statutory guarantee of conformity is renewed for a period of two years from the date the goods are replaced.

 

The consumer may obtain a reduction in the purchase price by keeping the goods, or terminate the contract and receive a full refund upon returning the goods, if:

 

1° The trader refuses to repair or replace the goods;

 

2° The repair or replacement of the goods takes place after a period of thirty days;

 

3° The repair or replacement of the goods causes major inconvenience to the consumer, particularly where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or where the consumer bears the installation costs of the repaired or replacement goods;

 

4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

 

The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or immediate termination of the contract. In such cases, the consumer is not required to request repair or replacement of the goods beforehand.

 

The consumer is not entitled to cancel the sale if the lack of conformity is minor.

 

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are returned.

 

The rights referred to above arise from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

 

A seller who, in bad faith, obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to as much as 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

 

The consumer also benefits from the statutory guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Codefor a period of two years from the date the defect is discovered. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.

 

The statutory guarantee of conformity applies independently of any commercial warranty that may also cover the Buyer’s goods.     

 


2.2) Warranty against hidden defects in the goods sold

Please note that the consumer may choose to invoke the warranty against hidden defects in the goods sold within the meaning of Article 1641 of the Civil Code within two years of discovering the defect.             

It is the Buyer's responsibility to prove, in particular, that the defect existed at the time of purchase, that it was hidden, and that it renders the product unusable.  

The Buyer may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

This warranty therefore entitles the Buyer to have the product repaired or replaced free of charge, subject to the cost conditions provided by law.    

Failing that, if repair or replacement is impossible or has not been carried out within one month of acceptance, the Company will refund the Buyer the price of the Product.

To make use of this warranty, the Products must be returned in the condition in which the Buyer received them, together with all items supplied (accessories, instructions, etc.) and a copy of the purchase invoice.     

Products returned by post must be sent in packaging suitable for safe transport. In this case, the cost of returning the product will be reimbursed to the Buyer based on the invoiced rate and upon presentation of supporting documents.              


2.3) Exclusion of legal warranties         

Any warranty is excluded in the event of misuse, negligence or lack of care on the part of the Buyer, as well as in the event of normal wear and tear of the Product or force majeure.
